Data for Tennis Terms of Service

Effective date: This version applies when you accept it, subject to Section 20 for existing contracts.
Last updated: 5 October 2026

1. Operator, scope and acceptance

These Terms of Service (Terms) govern the Data for Tennis website at datafortennis.com, accounts, developer console, API and related digital services and data exports we make available (together, the Service).

The operator and data licensor is ACYCLIC LABS LIMITED, a private limited company registered in England and Wales, United Kingdom, company number 16816653, with its registered office at 11 11 Ampton Road, Birmingham, United Kingdom, B15 2UH (Data for Tennis, we, us or our). For support, purchases, business enquiries, contractual notices and privacy matters, contact [email protected]. For direct sales we are the seller; Section 8.3 explains purchases from a separately identified reseller or merchant of record.

Our self-service offers are primarily for individuals. An individual may use an eligible offering for the commercial activities permitted by Section 5. Companies and other organizations seeking their own contract, shared team access or negotiated business terms should contact us at the same email address. Commercial use by an individual does not require a separate agreement merely because the individual's application or analysis earns revenue.

Customer, you and your mean the person accepting these Terms or, if expressly purchasing on behalf of an organization with our agreement, that organization. Anyone accepting for an organization must have authority to bind it. You must be at least 18 and have the legal capacity required to enter the contract in your jurisdiction.

A Consumer is an individual acting wholly or mainly outside their trade, business, craft or profession, or otherwise qualifying for consumer protection under the applicable law. A Business Customer acts in a business or professional capacity and does not qualify as a Consumer for the relevant purchase. An individual account, self-service checkout or use of developer tools does not determine this legal status by itself. Section 18 takes priority wherever mandatory consumer law applies.

You accept these Terms through an affirmative acceptance process that makes them available to you. An Order becomes binding when we, or the seller identified for that transaction, accept it by confirmation or activation of the agreed supply. Merely visiting the website does not create payment obligations or acceptance of all contractual risk provisions.

The Service is offered internationally where we can lawfully supply it and the relevant delivery and payment methods are available. A visible website or payment option does not guarantee availability in every territory. You must not misrepresent your location or identity to evade a lawful restriction. Restrictions do not remove rights attached to an already accepted Order.

Our Privacy Policy explains personal-data processing and our Cookie Policy explains device-storage technologies. Acceptance of these Terms is not consent to optional tracking, marketing or unrelated personal-data processing, and does not waive privacy rights.

2. Orders, entitlements and contract priority

2.1. What an Order covers

An Order is a particular offer for paid or free access that you accept and we accept, including a self-service checkout, purchase confirmation or other recorded access arrangement. No individually negotiated agreement or sales call is required for an offering made available for self-service purchase.

Your Entitlement is the scope of access agreed in that Order: the product, permitted uses, access period, applicable fees and billing arrangement, and any expressly disclosed quotas, rate limits, key allowances, usage measurement rules and other plan conditions. An account display is evidence of that Entitlement, not an independent power to change it. An obvious display error does not create additional rights, and a unilateral reduction in the display does not remove rights already agreed.

Current offers appear on our pricing page. Technical implementation details appear in the documentation. Before a purchase becomes binding, the applicable commercial and material technical conditions must be presented or clearly made available as part of the offer. The Order confirmation identifies or reproduces those conditions and the Terms version that applies, in a form you can retain. If a material parameter is not disclosed and accepted, we will not use an undisclosed parameter to impose an additional charge or restriction retrospectively.

2.2. Priority and incorporated material

Subject always to mandatory law, the following order of priority applies to an actual conflict:

  1. An agreement expressly accepted by both parties that identifies the provisions it varies.
  2. Product-specific or marketplace-specific terms and an Order expressly accepted by both parties, but only for the particular commercial, licence or technical subjects they expressly address.
  3. These Terms.
  4. The pricing, coverage and technical specifications expressly incorporated into the Order in the version applicable when it was accepted.
  5. Other documentation, which explains operation of the Service but does not independently expand the licence, create a service-level commitment or vary payment, liability or dispute provisions.

An Order or product-specific term varies the liability or dispute provisions only if it expressly identifies that variation. Purchase orders, procurement portals and other Customer documents do not add terms merely because we receive them, process an order or accept payment. A later statement in marketing material or an informal support discussion is not a negotiated amendment. This does not exclude liability for fraud or misrepresentation, or disregard pre-contract information and public statements that mandatory consumer law makes binding.

2.3. Existing Orders and future updates

A change to a public pricing page does not change the price or purchased scope of an already accepted, prepaid period. Corrections, security measures and permitted Service changes are governed by Section 10; contractual amendments and renewal changes are governed by Sections 8.2 and 20. A changed source restriction is not automatically an entitlement to charge more for an existing Order.

3. Nature and boundaries of the Service

The Service provides access to selected tennis facts and records, including match-level and point-by-point data where available, and ready-made statistics and aggregates. Those supplied records and responses, together with their associated selection, organization and documentation, are Licensed Data. Ready-made statistical responses remain Licensed Data; renaming, rearranging or reformatting them does not make them independently created results.

The applicable coverage information, documentation and Order describe what is supplied. Availability and detail can differ by competition, match, period, source, field and product. Unless expressly agreed, we do not promise complete seasons, complete player careers, every competition or statistical field, complete point sequences, or continuing supply from a particular source.

A separately offered data export (Export) is a delivery of the selection described in its Order, such as records for a stated competition and month, year or other period. Its scope, format, delivery terms and any snapshot or update entitlement are those disclosed before purchase. A period label describes the requested selection; it is not a promise that every event or field in that period exists in our coverage. An Export does not include ongoing API access or later corrected downloads unless the Order says so. Conversely, API access does not include a separately priced Export unless expressly included.

Only functionality released and included in your Entitlement is supplied. A roadmap, preview, sample integration or discussion does not promise release or inclusion in an existing purchase. We work to maintain reliable access, but do not offer a contractual uptime percentage, maximum latency, update frequency, support response time or service credit unless expressly agreed. Section 18 preserves mandatory standards for Consumer purchases.

Our records can be delayed, incomplete, estimated, reconstructed or corrected. A timestamp may represent an observed, received or derived time rather than the exact time of a sporting event. Historical records do not necessarily show what a market participant could have known at that historical time. You should assess the relevant definitions, limitations and suitability before using records in research, automation or a live decision system.

We supply tennis data, not betting odds, a sportsbook feed, betting signals, investment advice, trade execution or a guarantee of financial results. This does not prohibit lawful trading analysis or other commercial uses allowed by Section 5. You are responsible for the decisions, authorizations and safeguards of your own activities.

These Terms do not represent official-feed status, endorsement, exclusivity or affiliation with a player, competition, governing body or other rights holder. Names used to identify competitions or players do not confer rights to their branding.

An independent identity service, payment provider, marketplace or other external service may apply its own terms to its part of an interaction. We do not guarantee its continuing availability or performance. Its involvement does not remove obligations that remain ours, including mandatory obligations concerning the Service and personal data.

4. Accounts, authorized users and credentials

Provide materially accurate account and purchase information and keep it reasonably current. An individual self-service account belongs to its holder and is not a transferable pool of seats. Your application may serve end users under Section 5 without making those end users account holders or giving them your credentials.

You may use service providers and contractors to operate your permitted integration on your behalf, within your Entitlement. Any person given access to credentials or non-public Licensed Data must be subject to appropriate confidentiality, security and use restrictions, must act only on your behalf, and receives no right to reuse that access for unrelated customers. Additional independent users or organizational access require the relevant Entitlement or our written agreement. Persons permitted to access your account or integration on your behalf under this Section are Authorized Users.

You are responsible for your integrations, the permissions you grant and use by persons you authorize, subject to applicable law. Keep credentials and API keys confidential. Do not expose them in public repositories, public client-side code or shared documents. Inform us promptly at [email protected] if you suspect unauthorized access. You are not made responsible for a security failure attributable to us merely because it involves your account.

We may reject requests exceeding agreed limits, rotate or revoke compromised credentials, and apply proportionate safeguards against abuse. We will not count an undisclosed technical restriction as authorization for an additional charge. Section 11 governs suspension and termination.

We do not need your wallet seed phrase, wallet private key, complete payment-card security credentials or unrelated access secrets for ordinary support. Do not send them to us.

5. Licence, applications and Customer Outputs

5.1. Permitted access and commercial use

Subject to payment where applicable and compliance with the accepted Order, we grant you a limited, non-exclusive, worldwide licence, in territories where lawful, to access the Service within your Entitlement and to use lawfully obtained Licensed Data as described here. The licence is not transferable or sublicensable except for the limited contractor and end-user permissions expressly described in these Terms.

Permitted uses include personal analysis; academic and commercial research; calculation of statistics and indicators; building and operating applications, websites, bots, dashboards and terminals; lawful trading analysis and decision-support systems; and feature engineering, training, evaluation and operation of your own statistical or machine-learning models. You may charge for those applications, analyses and models, provided you do not redistribute Licensed Data as a standalone or substitutive data product.

This licence allows retrieval and local processing needed for those uses, including an internal research archive and any Export you lawfully acquire, within your purchased access and extraction limits. It does not expand the records, access period or capacity included in the Order.

5.2. Independently created results

Customer Outputs are your independently created analyses, reports, visualizations, forecasts, calculations, application code, features and model parameters that add substantive value and do not expose or enable reconstruction of Licensed Data as a substitute dataset or feed. Reformatting, compressing, relabelling, translating, lightly transforming or wrapping our records in another interface does not by itself create Customer Outputs.

As between you and us, you retain rights in your code and Customer Outputs. You may use and commercialize compliant Customer Outputs without a revenue share or an additional licence fee to us. This does not confer ownership of the underlying Licensed Data, confer third-party rights we cannot grant, or authorize a model or application designed to reproduce and distribute our records.

5.3. Display within applications and publications

You may display relevant scores, match facts and statistics to end users as part of a substantive application, terminal, report or research publication. An application does not become prohibited resale simply because it has paying users or incorporates Licensed Data into useful functionality.

You must not provide end users with our API keys, direct reusable access to our Service, a raw database download, or a general-purpose feed or API supplying our records in place of a subscription to Data for Tennis. Machine-readable redistribution of Licensed Data, including bulk customer downloads, requires our express written permission. Normal application communications needed to render permitted displays are allowed if they are not offered or usable as an independent replacement data service and are protected against straightforward bulk extraction by reasonable measures appropriate to the application.

Incidental inclusion of relevant records in a genuine report or publication is permitted; systematic publication of records sufficient to recreate a substitute archive is not. Contact [email protected] for broader redistribution rights.

5.4. Rights retained

We and our licensors retain rights in protected software, documentation, database selection and arrangement, marks and other supplied material. We do not claim exclusive ownership of unprotected sporting facts or restrict rights you obtain independently from lawful sources. Attribution obligations specifically disclosed and accepted for particular material remain applicable. These Terms impose no general obligation to promote our brand.

6. Storage and use after access ends

6.1. Retention of lawfully acquired data

You may cache, download and retain copies of Licensed Data lawfully obtained within your Entitlement, including purchased Exports. Unless your Order expressly and specifically states an agreed restriction before purchase, this permission has no contractual expiry and does not require you to keep paying for API access.

After a subscription expires or you cancel its renewal, you may continue to use those retained copies for the permitted personal and commercial purposes in Section 5. The same restrictions on resale, redistribution, security and lawful processing continue to apply. Ending paid access does not give you a right to make new API requests, obtain additional records, redownload an expired delivery link or receive future corrections without the relevant access entitlement.

We will not retroactively charge for continued permitted use of copies already acquired or remove that permission merely because a new plan has different terms.

6.2. Limits on continuing use

Continuing retention is a contractual licence, not an exemption from privacy law, another person's rights or a binding legal requirement. A valid legal requirement or applicable privacy-rights decision may require correction, restriction or deletion of particular records. We will identify the affected material and required action to the extent reasonably possible and lawful.

We may terminate the licence to affected retained Licensed Data for an irremediable material breach, deliberate unauthorized redistribution or a material breach not remedied after the notice and opportunity required by Section 11. Termination of API access alone does not automatically terminate the continuing licence to unrelated, lawfully acquired copies.

Where retention is no longer permitted, stop the affected use and delete the affected copies under your control, including copies held by contractors on your behalf, subject to lawful exceptions. Legally required evidence may be retained with restricted access solely for that purpose. Residual backup copies must not be restored to ordinary use contrary to a valid restriction or deletion requirement; applicable mandatory deletion rules prevail.

6.3. Independently created results

Lawfully created Customer Outputs may continue to be retained, used and commercialized after access ends without an additional fee to us. We do not require erasure of general knowledge, independently written code, lawful research conclusions or model parameters that satisfy Section 5.2. This permission does not authorize continued distribution of prohibited raw records or override an applicable privacy obligation or binding order.

7. Restrictions protecting the Service and data

You must not, and must not knowingly enable another person to:

(a) bypass authentication, rate limits, quotas, access controls or payment requirements, including through multiple accounts or rotating keys intended to evade an applicable limit;

(b) resell credentials or grant unauthorized sublicences; publish or redistribute Licensed Data beyond Section 5; or assemble, market or operate a substitute API, downloadable database or feed using Licensed Data without express permission;

(c) systematically extract or reconstruct a substantial part of a protected database outside the agreed licence, including through repeated extraction of smaller portions; authorized retrieval needed for permitted research or model training is not automatically a breach;

(d) scrape or access parts of our systems outside the interfaces and permissions made available to you, interfere with service operation, introduce malicious code or perform intrusive security testing without authorization;

(e) reverse engineer, decompile or disassemble protected software except to the extent applicable law expressly permits despite a contractual restriction; where that law allows an information request as a preliminary step, you may contact us;

(f) remove applicable proprietary notices, misrepresent the provenance of Licensed Data, or imply endorsement or rights that you do not hold; or

(g) use the Service or Licensed Data unlawfully, infringe another person's rights, evade applicable sanctions or export restrictions, or use information received through the Service in a way that violates applicable privacy law.

These restrictions do not prevent independent collection from lawful sources, interoperability activities protected by mandatory law, criticism, academic publication within the licence, or the creation of non-substitutive models and analyses.

8. Prices, payment, subscriptions and cancellation

8.1. Prices, taxes and measured usage

The price, currency, included access, billing frequency, access period and any minimum commitment are those presented and accepted in the Order. Prices and unavoidable charges must be disclosed before you become bound, including taxes where required. The seller responsible for a transaction will provide the applicable payment or tax documentation. These Terms do not impose our income taxes on you.

Additional usage charges or overage apply only where the Order specifies and you authorize the measured unit and charging basis. A rate limit does not itself authorize overage charges. Where no additional charging arrangement was accepted, reaching a limit may stop further requests or require you to choose another offering rather than create an undisclosed debt.

Our usage records are evidence, not conclusive proof that cannot be disputed. Send a billing query with the Order reference to [email protected]. We will investigate substantiated discrepancies and correct confirmed errors. No short contractual complaint window overrides a statutory right to challenge a charge.

8.2. Fixed-term access and automatic renewal

A subscription provides access for the period stated in its Order. Unless automatic renewal is expressly disclosed and separately agreed, a prepaid subscription ends at the stated expiry and requires a new payment or Order to continue. The word subscription does not, by itself, authorize us to debit a card, wallet or other payment method automatically.

An automatically renewing arrangement must identify the renewal period, price or determinable calculation, charging frequency, any minimum commitment and cancellation method before acceptance. Any required renewal consent is separate from general acceptance of these Terms. We do not convert free access into paid access, or manual renewal into automatic renewal, without the required authorization.

Changes to pricing do not change an already accepted prepaid period. Before a changed renewal price or other material renewal condition takes effect, we will give the notice, reminders and opportunity to cancel required by the applicable law and obtain fresh agreement where required. A website update or silence does not replace required consent. Where applicable California law requires notice of a fee change between 7 and 30 days before it takes effect, that timing applies. Other mandatory trial, renewal and annual reminders apply independently.

8.3. Payment providers, marketplaces and the seller

Available payment methods and the entity selling to you are identified in the relevant purchase flow and transaction confirmation. Payment options may differ by country, product and provider. A method not offered for your Order is not available merely because it is mentioned in a general product discussion.

A payment processor can handle a payment on our behalf without becoming the seller. Alternatively, a separately identified reseller or merchant of record can sell to you in its own name and issue the invoice. Its buyer terms then govern its sale and payment functions; these Terms govern our Service and data licence to the extent applicable and consistent with mandatory law and the relevant purchase agreement. No description in these Terms converts a processor into a reseller.

Where a reseller controls payment, cancellation or refund processing, requests relating to its transaction follow the route disclosed for that purchase. You may also contact [email protected] for assistance with the Service and identification of the responsible seller. We do not use a provider's involvement to exclude obligations that remain ours. A refund for a reseller transaction must be coordinated through that seller; you are not required to accept an unrelated replacement purchase or account credit instead of a legally due refund.

8.4. Cryptocurrency payments

This section applies only when cryptocurrency payment is offered and selected for an Order. Follow the particular invoice instructions for the asset, network, destination address, amount, any memo or tag, and quote expiry. Do not assume an address or quote from an earlier payment is reusable. Access may depend on the required payment confirmations and legitimate payment-provider checks.

An unsupported asset, wrong network, incorrect destination, omitted memo, expired quote, underpayment or a transfer not matched to your Order may prevent automatic fulfilment. Contact us with the transaction identifier if that occurs. A pending or unmatched transfer is not automatically a completed purchase, but we will account for funds actually received as required by law. We do not promise recovery of funds that neither we nor the relevant provider can access. This does not excuse an error in payment instructions attributable to us or any other responsibility that cannot lawfully be excluded.

Network congestion, wallet or exchange restrictions, conversion charges and exchange-rate changes may affect payment. Any charge included in the price or imposed by us must be disclosed as required by law. You are responsible for independently charged wallet, exchange and network fees to the extent the law permits.

A blockchain transaction may be technically irreversible. That does not remove a right to cancel, obtain a refund or receive another mandatory remedy. A refund is a separate transaction or another lawful repayment arrangement, not a reversal of the original blockchain record.

The contractual price currency stated in the Order determines the amount owed. For an Order priced in a fiat currency and settled in crypto, a refund is calculated by reference to the refundable amount in that price currency, not by assuming that a historical crypto quantity has an unchanged value. Any conversion method and resulting repayment arrangement must be clearly explained and agreed where required. For a price expressly denominated in cryptocurrency units, the refundable amount is the appropriate number of those units. Mandatory rules requiring another calculation prevail.

Refunds use the original payment method unless you expressly agree to another lawful method. The responsible seller or processor may require proportionate checks of a compatible refund destination, particularly for exchange or custodial-wallet payments. We will not ask for a seed phrase or private key. No network charge, conversion arrangement, verification process or provider policy is used to reduce a mandatory refund, impose a prohibited reimbursement fee or extend a statutory deadline. Changes in the market value of an asset do not create a separate promise by us to compensate market losses.

8.5. Cancelling renewal

For a direct purchase, send a clear cancellation request to [email protected], with information reasonably sufficient to identify your account or Order. You may also use the cancellation route provided with your purchase. Any legally required online or same-medium cancellation route remains an additional right; email is not imposed as its exclusive replacement.

Unless mandatory law or the Order provides otherwise, cancellation stops future renewal while access continues for the remainder of an already paid period. A clear cancellation received before a renewal becomes chargeable takes effect for that renewal. A delay in our support processing does not authorize an unwanted additional renewal. We will confirm the cancellation in a retainable communication.

Cancelling renewal, closing an account, withdrawing during a statutory cooling-off period and terminating for non-conformity are different actions. Tell us which you intend; no special wording is necessary where your intention is clear. We will not require a support conversation or justification where the law entitles you to cancel directly.

8.6. Non-payment and refunds

We may suspend unpaid access after notice and a reasonable opportunity to resolve a payment failure, unless an immediate restriction is justified by fraud, unauthorized charges or another ground in Section 11. Properly incurred and undisputed charges remain payable. Exercising a lawful chargeback, cancellation or Consumer remedy is not itself abuse.

Except as expressly stated in the Order or required by law, we do not offer refunds simply because you used less than your allowance, changed your plans, no longer need the data or forgot to use the Service. Delivered Exports do not carry a discretionary change-of-mind return right beyond any applicable statutory right.

Those rules do not remove correction of overcharges, repayment for unprovided prepaid access under Section 11.3, statutory withdrawal, conformity remedies or any other legally required refund. Section 18 explains Consumer rights. A damages cap does not reduce repayment that is required under those provisions.

9. Free, demonstration and experimental access

If we offer free access, a demonstration, trial, preview or beta feature, its specific scope and any conditions will be stated in the applicable offer. There is no assumed trial duration, payment-card requirement or automatic conversion to a paid subscription.

We may change or end access that is genuinely free and not an agreed component of a paid Order, and may provide experimental features without a commitment to maintain compatibility or release them generally. Where practicable, we will give notice of a material withdrawal. Such access has no additional support, uptime or availability commitment unless expressly agreed. Mandatory law, including applicable rules for digital services supplied in exchange for personal data, remains unaffected.

The Business Customer disclaimers and free-access liability limit below apply to the extent permitted by law. Labeling an expressly purchased, committed feature as beta after purchase does not remove an agreed obligation.

10. Corrections, maintenance and changes to the Service

We may correct data and errors, change sources, maintain or improve security, respond to legal requirements, manage abuse, improve performance, update technologies, and introduce or retire versions or endpoints. These are the reasons for which changes may be made; they are not a right to replace the core purchased service arbitrarily.

For planned changes likely to materially affect an existing integration, we will give notice reasonably in advance and identify the affected functionality or migration information where practicable. The appropriate notice depends on the nature of the change and the circumstances; no perpetual version support is promised. Urgent changes to address a security threat, unlawful content, rights restriction, serious abuse or binding legal requirement may take effect immediately. Notice may be delayed where disclosure would create a security risk or be unlawful.

No change automatically creates an additional charge or retrospectively alters an accepted Order. A source disappearing or a field being corrected does not itself establish a breach where permanent access or particular completeness was never promised. Conversely, a source disclaimer does not excuse an express, material commitment or a mandatory conformity obligation.

If we can no longer lawfully or practically provide a material part of committed paid access, we may provide a reasonably equivalent lawful alternative within the agreed purpose, restore conformity where required, or end the affected part of the Order with the prepaid-access consequences in Section 11.3. Consumer modification and remedy rights in Section 18 apply in priority.

11. Suspension, termination and their effects

11.1. Grounds and procedure

We may restrict or suspend the affected access where reasonably necessary because of compromised credentials, a material security risk, suspected fraud or abuse supported by reasonable grounds, material licence breach, non-payment, a credible rights complaint or a binding legal requirement. The scope and duration of the measure should be proportionate to the issue. Where lawful and reasonably safe, we will explain the material reason and how to seek review at [email protected].

For a remediable material breach, we will normally give notice and a reasonable opportunity to cure before terminating for that breach. Immediate termination or restriction is available where the breach is irremediable, repeated after warning, involves deliberate evasion or unauthorized redistribution, or delay would expose the Service, another person or us to material harm or illegality. We may withhold details that would expose security controls or violate law.

You may end use or cancel renewal under Section 8, and either party may terminate for an uncured material breach by the other where the applicable law and these Terms permit. Mandatory Consumer termination rights do not depend on our agreement that a breach occurred.

11.2. Ending access for other reasons

We may discontinue the Service or decline a future Order or renewal. For an existing paid committed period, termination for our convenience requires reasonable advance notice where practicable and the refund treatment in Section 11.3. We may not retain payment for an unprovided remainder merely by calling a discontinuation a change of policy.

11.3. Prepaid amounts and accrued fees

If we terminate or permanently discontinue committed access for a reason other than your material breach, we will refund the prepaid fees allocable to the affected, unprovided remainder. For time-based access, allocation is proportionate to the remaining period; for another accepted charging model, allocation follows the unused purchased component. A partial discontinuation affects the corresponding component, not automatically every unrelated purchase. More favorable mandatory remedies prevail.

After termination for your material breach, properly earned fees remain payable. We may retain prepaid amounts only to the extent permitted by law and the accepted Order; this is not an automatic entitlement to a penalty, accelerated future renewal fees or double recovery. Any amount that must be repaid by law will be repaid. Contractual repayment of unprovided fees and mandatory refunds are not reduced by the damages cap in Section 16.

11.4. Data and continuing provisions

When access ends, stop making requests and cease uses that require a current licence. Copies of Licensed Data and Customer Outputs are governed by Section 6. Account deletion and personal-data retention are governed separately by the Privacy Policy and applicable law; ending a subscription does not require immediate erasure of legitimate billing records, and retention of billing records does not permit continued product access.

Accrued payment rights, restrictions on retained Licensed Data, permitted continuing Customer Output rights, confidentiality for its stated duration, intellectual-property provisions, applicable liability and indemnity provisions, dispute provisions and terms needed to resolve accrued matters survive to the extent relevant. This is not a perpetual obligation to subscribe or advertise Data for Tennis.

12. Personal data and downstream use

We process account, usage and other personal data as described in the Privacy Policy. A data-access licence is not consent from a player or other individual, and public availability does not automatically remove privacy protection.

You are responsible for determining your role and legal grounds for personal-data processing in your own integration, providing required notices, protecting information, and honoring applicable rights. Ordinarily, we and a Customer independently determine the purposes and means of our respective uses of athlete information. The label in these Terms does not override the actual facts. Where a processing activity genuinely requires an agreement under Article 28 GDPR or an international-transfer instrument, the necessary instrument must be in place before that activity; neither these Terms nor the Privacy Policy replaces it.

Where we communicate a legally required correction, restriction, deletion or opt-out affecting Licensed Data you received, you must implement it to the extent applicable to you and your recipients, and provide reasonable confirmation on request. You may identify a legally available exception, but cannot disregard a valid instruction solely because the record was paid for. We remain responsible for our own obligations and cannot transfer them wholesale to you.

Where Licensed Data transferred to you is personal information governed by the California Consumer Privacy Act (CCPA) and you receive it as a third party, we make that information available only for the following limited purposes, to the extent included in your Entitlement: research into tennis competitions and performance; calculation of tennis statistics; operation of the tennis-data features of your applications, bots and terminals; statistical analysis of tennis performance for lawful trading research and decision support; and feature engineering, training, evaluation and operation of models based on tennis records. You must use that information only for those purposes and within the disclosure and retention limits of the accepted licence.

For that information, you must comply with the applicable CCPA and implementing regulations, provide the same level of privacy protection they require of a business, implement the reasonable security required by law, and comply with applicable restrictions on sale, sharing and onward disclosure. You must reasonably cooperate with us in implementing consumer requests affecting the information, including legally required deletion, correction and sale/sharing opt-outs forwarded to you. You must promptly notify us after determining that you can no longer meet those obligations. We have the right to take reasonable and appropriate steps to verify compliant use, including proportionate information requests or compliance attestations, and, on notice, to stop and remediate unauthorized use, including requiring confirmation that affected information is no longer retained or used where legally required. Nothing in this provision authorizes a transfer prohibited by an opt-out or dispenses with a required notice, agreement or consent.

13. Confidentiality and Customer materials

Non-public credentials, security information, expressly confidential commercial terms and other information disclosed in circumstances that reasonably indicate confidentiality are Confidential Information. Public sporting facts and publicly available documentation are not confidential merely because supplied through the Service.

A recipient must use the other party's Confidential Information only to perform or exercise rights under the contract, protect it with reasonable care, and disclose it only to personnel, contractors and advisers who need it and are subject to appropriate confidentiality duties. Information independently developed, lawfully received without restriction, already lawfully known or made public without breach is excluded. Legally compelled disclosure is allowed to the required extent, with prior notice and reasonable protective cooperation where lawful and practicable.

These duties continue for three years after the relevant contract ends, and for trade secrets for as long as they remain protected as trade secrets under applicable law. Credential restrictions and statutory personal-data duties are not shortened by that period.

If you send code, logs, files or other materials for support, you authorize only the access, reproduction and handling reasonably necessary to address the request, operate the agreed Service and meet applicable legal obligations. Do not send secrets or third-party personal data that are unnecessary for the request. No ownership transfer or general-purpose model-training licence is granted by sending support materials.

14. Feedback and publicity

If you voluntarily provide non-confidential suggestions about the Service, you grant us a worldwide, non-exclusive, royalty-free right to use, adapt and incorporate those suggestions without an obligation to compensate you. This right covers the suggestion, not unrelated software, personal data, third-party confidential information or other materials you have not authorized us to use. Do not submit confidential information as feedback unless separately agreed.

Neither party receives a general right to use the other's name, logo or marks in advertising, endorsements or customer lists. Such publicity requires separate permission, except for uses independently permitted by law.

15. Warranties and operational risk

For Business Customers, except for express obligations in an accepted Order and obligations that cannot lawfully be excluded, the Service and Licensed Data are supplied as is and as available. To the extent legally permitted, we exclude implied warranties and conditions concerning satisfactory quality, merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, uninterrupted availability and non-infringement.

For Consumers, descriptions of coverage and limitations explain the product you purchase; they do not exclude mandatory standards of conformity, reasonable care and skill or other legally protected expectations. Section 18 applies.

We receive and process information from external sources. Their quality does not eliminate the possibility of omissions, errors, delayed updates, changes in format or interrupted supply. We do not guarantee a particular source will remain available, and do not undertake a service-level commitment merely by seeking reliable suppliers or working to improve the Service. This does not excuse our own agreed obligations or statutory responsibilities.

You remain responsible for assessing suitability, checking material results where appropriate, maintaining your own safeguards and backups, and complying with the rules applicable to your application or decision process. You must not represent that we guarantee a trading return, sporting prediction or regulatory approval. We do not assume a contractual obligation to insure your trading, business or investment outcomes.

16. Liability

16.1. Liabilities that remain protected

Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or another liability that cannot lawfully be excluded or limited. Nothing restricts mandatory consumer remedies, protected rights concerning personal data, a regulator's powers, or a refund expressly due under these Terms or mandatory law. An exclusion or cap applies only to the extent legally enforceable.

16.2. Consumers

If you are a Consumer, we are responsible for loss you suffer as a legally recoverable result of our breach or negligence, subject to the applicable rules on causation, foreseeability and mitigation. We are not responsible merely because a sporting result, model, investment or trade differs from your expectation, or for a loss caused independently of a breach or other fault for which we are legally responsible.

The Business Customer exclusions and financial cap below do not apply to Consumers. Your rights to a conforming supply, repair or repeat performance where applicable, a price reduction, repayment or other mandatory remedy are not made conditional on the amounts in that cap.

16.3. Business Customer exclusions

For Business Customers, subject to Section 16.1, we are not liable for indirect, consequential, special or punitive damages, or for loss of profit, revenue, anticipated savings, business opportunity, goodwill, contracts or trading or investment returns, whether the latter categories are characterized as direct or indirect. We also exclude the costs of reconstructing research or training work and losses arising from your downstream products to the extent the law permits their exclusion.

These exclusions do not turn an expressly promised supply into an optional obligation and do not exclude a type of loss where applicable law prohibits doing so.

16.4. Business Customer aggregate cap

Subject to Section 16.1, our total aggregate monetary liability to a Business Customer arising from the Service, Licensed Data and the agreement, whether in contract, tort including negligence, misrepresentation, restitution or otherwise, is limited to:

(a) the fees paid or payable for the affected subscription or access service attributable to the three months immediately preceding the first event giving rise to the claim; plus

(b) the price paid or payable for any separately purchased Export directly giving rise to the claim.

Prepayments are allocated proportionately over the access period they purchase, regardless of the date payment was made. If the relevant paid access lasted less than three months, its shorter period applies. If a claim arises after that access has ended, the last three months of that paid access, or its shorter actual duration, are used instead. Related events are treated as one event occurring when the first occurred. The cap is aggregate across claims, not a new allowance for each claimant, cause of action or incident; a separately accepted written agreement may expressly provide otherwise.

For liability arising exclusively from a genuinely free offering with no relevant paid subscription or Export, we exclude monetary liability to a Business Customer to the extent permitted by law. A component included in a paid Order is not treated as free merely to apply that exclusion.

16.5. No duplicate recovery

The same loss cannot be recovered more than once. This section does not impose an additional contractual deadline for a valid claim or prevent an application for relief that applicable law does not permit us to exclude.

17. Business Customer indemnity

This Section applies only to Business Customers. You will defend us and our personnel against a third-party claim, and indemnify us for damages and reasonable legal costs finally awarded or included in a settlement approved under this Section, to the extent caused by your or your Authorized Users' unlawful use of the Service, unauthorized distribution or sublicensing of Licensed Data, material breach of the licence restrictions, or infringement by materials you independently provide.

The obligation does not cover a claim to the extent caused by our breach, negligence, unlawful conduct or unauthorized modification. In particular, an allegation that Licensed Data supplied by us infringes a third party's rights is not shifted to you merely because you used it as expressly permitted and without a relevant Customer breach.

We will give reasonably prompt notice of the claim; delay relieves you only to the extent it materially prejudices the defense. You may control the defense using competent counsel reasonably acceptable to us, and we will provide reasonable cooperation at your expense. We may participate with separate counsel at our own expense, except where a material conflict requires separate representation whose reasonable cost is properly part of the covered defense.

You may not settle without our prior written consent unless the settlement gives each protected party an unconditional release, requires no admission of fault, imposes no material non-monetary obligation on it, and is fully paid by you. Consent will not be unreasonably withheld to a settlement meeting those protections. If you fail to assume a covered defense after a reasonable opportunity, we may defend and recover reasonable covered costs. This Section does not create an indemnity for every allegation or for our own responsibility.

18. Consumer rights

18.1. Mandatory protections

Consumers retain mandatory rights under the law applicable to their purchase, including UK rights concerning digital content and services and applicable national laws implementing EU consumer rules. These can include conformity with the contract, supply with reasonable care and skill, binding pre-contract information, legally required updates, correction or repeat performance, price reduction, termination and repayment.

An as-is clause, no-SLA statement, source interruption, cryptocurrency payment, foreign governing law, marketplace involvement or no-discretionary-refunds rule does not remove those rights. A specific deviation from an otherwise required conformity standard is effective only where the relevant legal conditions, including specific information and separate acceptance where required, are met.

Contact [email protected] with a description of a supply or conformity problem. No wording in these Terms requires you to forgo another valid complaint route or wait for an ordinary support response before exercising a time-sensitive right.

18.2. UK and EU/EEA withdrawal rights

Where the applicable distance-selling law provides a withdrawal right, you normally have 14 days from the day after the contract is concluded to withdraw from a service or digital-content purchase without giving a reason, subject to the lawful exceptions below. The applicable local calculation and any longer mandatory period prevail. If required withdrawal information was not supplied, the withdrawal period can be extended by up to 12 months; supplying that information during the extension starts the further period required by law.

To withdraw, send an unequivocal statement identifying the contract to [email protected] or to ACYCLIC LABS LIMITED, 11 11 Ampton Road, Birmingham, United Kingdom, B15 2UH. Sending it before the withdrawal deadline is sufficient. You do not have to use the model form in Section 18.3.

You may also use an online withdrawal function where provided for your purchase. Where applicable law requires that function, it must remain prominently and continuously available throughout the withdrawal period and provide a retainable acknowledgement of your statement, including its content and submission date and time, without undue delay. Email and postal withdrawal remain available; an unavailable or defective online function does not remove your right. Withdrawing from a contract is distinct from turning off its next renewal.

For a valid withdrawal, the responsible seller reimburses the covered payments without undue delay and no later than 14 days after being informed, using the original payment method unless you expressly agree otherwise, and without a reimbursement fee. For a direct sale, that obligation is ours. Section 8.4 applies to cryptocurrency repayment without reducing the statutory entitlement.

For a service started during the withdrawal period at your express request, you may owe only the proportionate amount for the service actually supplied before withdrawal, where all statutory conditions were met. The calculation uses the agreed total price or, where legally required because that price is excessive, the market value. No such amount is charged where the required information or express request was missing.

The withdrawal right for a service is lost on full performance only if the applicable requirements for prior express consent and acknowledgement have been satisfied. Issuing an API key or making a first API request is not full performance of an ongoing subscription.

For a separately supplied Export or other digital content not on a tangible medium, the withdrawal right may be lost once supply begins only where you gave the required prior express consent to immediate supply, acknowledged the resulting loss of the right, and received the required confirmation. General agreement to these Terms, or merely paying in cryptocurrency, does not establish those separate consents. The legal classification of the actual supply determines which rule applies.

On withdrawal from a data purchase, stop using and distributing the affected Licensed Data and comply with applicable return or deletion consequences. Section 6 does not authorize keeping the benefit of a fully refunded purchase without a continuing lawful licence. Independently created Customer Outputs are treated in accordance with Section 6.3 and applicable law. Where law requires return of non-personal content you provided or created and we hold, we will provide it in the required manner, subject to statutory exceptions.

18.3. Optional model withdrawal form

To: ACYCLIC LABS LIMITED, 11 11 Ampton Road, Birmingham, United Kingdom, B15 2UH; [email protected]

I/We hereby give notice that I/We withdraw from my/our contract for the supply of the following service or digital content.

Service or digital content and Order reference: ____________________
Ordered on / contract concluded on: ____________________
Name of Consumer(s): ____________________
Address of Consumer(s): ____________________
Signature of Consumer(s), only if submitted on paper: ____________________
Date: ____________________

Delete or omit the alternatives that do not apply. This form is optional; a clear withdrawal statement is sufficient.

18.4. Changes to a continuing digital service

Where national law implementing Article 19 of Directive (EU) 2019/770 applies, a change beyond what is necessary to maintain conformity requires a valid contractual reason of the kind identified in Section 10, no additional cost and clear information about the change. Where it adversely affects access or use more than only to a minor extent, the required advance information must be provided on a durable medium.

You may then terminate without charge within 30 days after receiving that information or the change taking effect, whichever is later, unless the unchanged conforming service remains available to you without additional cost as permitted by law. Applicable price-reduction and termination refunds are made without undue delay and within the statutory 14-day period. Security measures do not eliminate mandatory remedies.

19. Governing law and disputes

These Terms and non-contractual matters arising from them are governed by the laws of England and Wales, subject to mandatory rules that require another law to apply. For Business Customers, the courts of England and Wales have exclusive jurisdiction, except where a mandatory rule provides otherwise.

For Consumers, this choice does not deprive you of mandatory protections that would otherwise apply, including protections of your habitual residence where applicable. A Consumer entitled to sue in their home courts may do so, and we may bring proceedings against a Consumer only in a forum allowed by the applicable mandatory rules. Privacy complaints and regulatory powers are not confined to an exclusive contractual forum.

You may contact [email protected] to seek an informal resolution. Doing so is not a compulsory precondition to a statutory remedy, court action or regulatory complaint, and does not shorten a legal limitation period. Where law requires information about an appropriate alternative dispute-resolution body after an unresolved complaint, we will provide it and state whether we are required or willing to participate. These Terms do not impose mandatory arbitration or a class-action or jury-trial waiver.

20. Amendments and notices

We may revise these Terms for new Orders and, with the required notice and agreement, future renewals. Material changes affecting an existing Customer will be notified by email or another suitable direct, retainable communication before they apply. A website update alone does not retrospectively amend an accepted Order or establish fresh consent where the law requires it.

During a paid committed period, materially adverse contractual changes require your agreement or a specific lawful basis and the safeguards applicable to that change. If continuing on the existing terms is no longer lawful or reasonably possible, we may end the affected access under Sections 10 and 11 rather than assert that silence accepted new obligations. Non-material clarifications and changes strictly required by law may take effect to the extent appropriate, without removing accrued rights. Security and technical changes are separately governed by Section 10.

Contractual notices to us should be sent to [email protected] or our registered address. This does not invalidate a Consumer or privacy notice delivered through another legally effective channel. We may send notices to the current contact associated with your account. You must keep that contact reasonably current, but this does not override a mandatory delivery requirement or deem a notice received when applicable law would not do so. Court documents and regulated notices must be served as the applicable rules require.

A Privacy Policy or Cookie Policy update explains processing; it does not amend a purchased licence or authorize a new processing purpose or optional tracking by itself.

21. General provisions

21.1. Events outside reasonable control

Neither party is liable for delay or failure to perform to the extent caused by an event genuinely beyond its reasonable control and not reasonably avoidable through appropriate precautions. The affected party must take reasonable steps to reduce the impact and resume performance. An ordinary preventable security failure, financial difficulty or an act within the party's control is not automatically such an event. This provision does not excuse payment for access already supplied, permit retention of amounts that must be refunded, or displace mandatory Consumer remedies.

21.2. Assignment and subcontracting

A Business Customer may not transfer the agreement or its access to another entity without our prior written consent, except as expressly agreed in an Order. We may transfer the agreement as part of a merger, reorganization or transfer of the business to a successor capable of performing it, subject to notice and any consent required by law. A transfer does not itself increase fees, reduce existing obligations, expand processing purposes or deprive a Consumer of mandatory rights. We may use subcontractors but remain responsible for our contractual obligations to the extent applicable law and the contract require.

21.3. Entire agreement, severability and no waiver

The agreement consists of these Terms and the accepted materials incorporated under Section 2. It supersedes prior discussions on the same subject, without excluding fraud, legally protected reliance or mandatory pre-contract information. The parties are independent contractors; neither may bind the other merely by using the Service.

If a provision is invalid or unenforceable, it is severed to the extent the applicable law permits and the remainder continues where it can lawfully do so. This is not a direction to rewrite an unfair Consumer term. A failure or delay to enforce a right is not a waiver; a waiver of one breach does not waive a different breach. Neither party may recover twice for the same loss.
